Terms of Service
Last updated: October 16, 2026 · Version 1.11
1. Provider, Scope, and Contract Formation
The provider of the "Lunchdate" iOS app and the associated website is:
Lunchdate UG (haftungsbeschränkt)
c/o betahaus GmbH, Rudi-Dutschke-Straße 23
10969 Berlin
Germany
Represented by the Managing Director: Joshua Sames
Commercial Register: Local Court of Charlottenburg, HRB 287820 B
Phone: +49 160 94953668
Email: support@lunchdate.io
(hereinafter "Lunchdate," "we," or the "Provider")
These Terms of Service apply to the use of the Lunchdate iOS app and the account-related functions on lunchdate.io (the "Service"). They do not apply to an Android app. Merely visiting the website for informational purposes does not create a user contract.
The free user contract is formed when you:
- confirm that you are at least 18 years old;
- expressly agree to these Terms of Service in the version displayed during registration; and
- register using Sign in with Apple and we successfully activate the account.
The Privacy Policy is acknowledged; it is not consent and is not a contractual provision that limits data protection rights. Any consent that is required, for example for product analytics, location, or push notifications, is obtained separately.
Purchases or subscriptions concluded through the Apple App Store are additional Store transactions. The merchant shown in the purchase dialog and on the receipt is the contracting party for that Store transaction. Section 7 contains supplementary provisions.
Before starting Sign in with Apple, you can review and change your selection accepting these Terms and read the linked legal documents. You can cancel the sign-in process before it is completed. You can review and correct profile information during the subsequent onboarding.
For your account, we record the version of these Terms you accepted, its document language, and the time of your acceptance. After successful acceptance, the app keeps a copy of the accepted version under “Legal documents” for you to read, save, or share.
2. Purpose and Scope of the Service
Lunchdate supports professional networking around in-person meetings. In particular, users can:
- create a professional profile and discover other profiles;
- express interest and, following mutual interest, use a connection;
- exchange messages and propose, coordinate, and manage meetings;
- plan one-to-one or group meetings for lunch, coffee, dinner, after-work activities, or other professionally oriented activities;
- search for venues, add new places with basic factual information, and report errors; and
- use Pro, Spotlight, and referral features where available.
To use the Service, you need a compatible Apple device, an iOS version supported on the current App Store product page, an internet connection, and an Apple Account. Individual functions require the device permissions described in Section 13 of the Privacy Policy. Current compatibility and further technical requirements are displayed on the App Store product page before download.
We owe the technical provision of the Service, not the creation of a connection, meeting, reservation, business relationship, or any particular professional success. We are neither a party to an in-person meeting nor to any contract between users or between a user and a venue.
2.1 Recommender System and Visibility
Discovery uses automated filters and a relevance score. The current main parameters and their relative importance are:
| Parameter | Maximum weighting in the regular relevance score |
|---|---|
| same or related industry | 25 points |
| same or complementary networking goals | 15 points |
| shared professional interests | 10 points |
| shared personal interests | 10 points |
| distance, calculated from current coordinates using the Haversine formula | 20 points |
| recency and engagement | 20 points |
| availability "today for lunch" | 10 points |
The following currently also apply:
- interest already expressed by another profile may increase that profile's score by up to 20 points;
- a small component of up to five points, recalculated daily, varies ties;
- geohashes are used only to efficiently preselect nearby candidates; they are not the distance calculation;
- blocked, deleted, suspended, or paused accounts and profiles outside the selected distance, language, or company filters are not displayed;
- a profile in Stealth mode is shown only to people in whom that profile has already expressed interest and in technically necessary exceptional cases; and
- active Spotlight profiles form a separate group, labeled "Spotlight," ahead of the regular ranking. The relevance score continues to determine the order within that group.
Filters, availability, location density, and technical caps may mean that not every potentially suitable profile appears in a query. Spotlight does not guarantee views, a connection, or a meeting.
We may change parameters if there is a valid reason within the meaning of Section 11. We will provide information under Section 11 about changes that impair use to more than an insignificant extent.
3. Registration and Account
3.1 Requirements
You may use the Service only if you:
- are at least 18 years old and have legal capacity;
- use the Service for professional networking and not as a dating service;
- provide accurate and non-misleading information; and
- have not previously been effectively and permanently excluded, unless we have expressly agreed to renewed use.
The Service is intended in particular for professionals, self-employed people, founders, university and vocational students, interns, job seekers, and other adults with an interest in professional networking.
3.2 Sign in with Apple and Account Security
Registration offered in the iOS Service takes place exclusively through Sign in with Apple. As a rule, you may maintain only one personal account. You must protect access to your Apple Account and your device and notify us at support@lunchdate.io if you suspect unauthorized use.
Accounts are not transferable. Automatically created, shared, or falsely identified accounts are not permitted.
3.3 Profile and Reachability
Required information must be complete and current. You can change or remove optional information. Apple relay email addresses must remain reachable so that we can deliver legally or security-related required communications.
A paused profile continues to exist as an account but is restricted or not displayed in Discovery. Pausing neither terminates the user contract nor an Apple subscription.
4. Conduct and Content Rules
4.1 Respectful and Lawful Use
In particular, the following are prohibited:
- harassment, threats, stalking, hate speech, discrimination, or sexually or romantically intrusive approaches;
- unlawful, fraudulent, misleading, insulting, or violence-glorifying content;
- impersonation or use of another person's photos without authorization;
- publication of confidential information or third-party personal data without a legal basis;
- spam, pyramid schemes, aggressive solicitation, unsolicited mass advertising, or repeated sales messages where the recipient has shown no discernible interest;
- scraping, bots, automated account or messaging activity, manipulation of limits, or other circumvention of technical safeguards;
- malware, phishing, attempts at unauthorized access, or interference with the Service;
- use for dating, escort, sexual, or other unrelated contact offerings; and
- infringements of third-party rights, in particular copyrights, trademarks, personality rights, or data protection rights.
Mentioning your own professional offerings is permitted if relevant to the conversation, transparent, and not intrusive.
There is no tolerance for objectionable content or abusive users: we remove such content and take action against the accounts responsible under Section 9.3.
4.2 Profile and Group Photos
Photos must accurately depict you or the group shown. The primary profile photo must contain at least one recognizable human face. In particular, nudity, violence, hate symbols, third-party copyrighted images without permission, misleading AI-generated images, and images consisting predominantly of advertising or contact details are prohibited.
For group images, you must possess the necessary rights and consents of recognizable people. Remove an image if a depicted person raises a justified objection.
4.3 Messages and Meetings
Respect rejections, blocks, and personal boundaries. Share sensitive business, identity, or payment data only where necessary and appropriate. Arrange in-person meetings on your own responsibility and follow the safety guidance in the app.
5. Usage Limits and Technical Safeguards
5.1 Current Standard Limits
- Free account: 100 decisions in Discover ("Lunch" or "Not a fit") per day and 30 messages per minute per connection;
- Pro: currently unlimited decisions in Discover, with the limit of 30 messages per minute per connection continuing to apply.
Daily limits currently reset once a day; when a limit is reached, the app shows when it resets. Additional reasonable limits may apply to reports, uploads, invitations, exports, search queries, and other security-relevant functions.
5.2 Enforcement and Changes
If limits are exceeded, actions may automatically be rejected, delayed, or discarded. Repeated attempts to circumvent them may be treated as misuse.
We may adjust limits where necessary for security, stability, fair use, or protection against automated misuse. Changes to promised functions are additionally governed by Section 11.
6. Group Lunches and Open Meetings
6.1 Creation, Participation, and Visibility
Group lunches can be created directly or from an existing connection and plan. Depending on the starting point, another person's approval may be required. Open group lunches may be displayed to suitable users in the vicinity of the meeting point.
The participant count can be selected; it is four by default and no more than ten people. Security, legal, or abuse-prevention reasons may require a lower limit or restricted visibility.
Hosts can manage participation requests, meeting point, description, and status within the app's functions. Completed meetings may be archived after an operational follow-up period.
6.2 Host's Role and Responsibility
Lunchdate provides only the technical planning and communication function. The host coordinates the specific meeting but, for that reason alone, is not necessarily the organizer of a commercial or public event and is not liable for the independent conduct of other participants solely because of the host role.
The host is responsible for their own culpable acts and for organizational or statutory duties that actually apply to them in the specific case, such as permits required for a special event initiated by the host. Each participant remains responsible for their own conduct and compliance with applicable law.
The host indemnifies us only against justified third-party claims to the extent that the host caused them through a culpable breach of the host's own duties. The indemnity includes necessary and reasonable legal-defense costs and is reduced in the event of contributory fault by Lunchdate. Mandatory law remains unaffected.
7. Pro, Spotlight, Referrals, Contributions, and Apple Purchases
7.1 Pro Features
Depending on the scope displayed when purchased or activated, Lunchdate Pro may include in particular:
- unlimited decisions in Discover;
- a view or filter for people who have already expressed interest;
- Travel mode;
- Stealth mode; and
- a monthly Spotlight allowance.
The precise scope, price, billing period, and any trial period are displayed in the App Store interface before purchase. Undoing your most recent Discovery decision is part of the free Service and is not a Pro feature.
7.2 Spotlight
An activated Spotlight places your profile, for the displayed duration—currently usually 30 minutes—in the labeled Spotlight group described in Section 2.1. The precise duration is shown in the app before activation.
Active Pro access currently includes one free Spotlight per calendar month. The monthly allowance resets at the start of each month according to UTC; unused monthly Spotlights do not carry over. Additional Spotlight credits may be available as individually consumable in-app purchases or as rewards. Purchased and already credited additional Spotlights can also be used without active Pro access. Credits are account-bound, non-transferable, and cannot be redeemed for cash. Only one Spotlight can be active at a time. Activation consumes an available credit; no particular outcome is guaranteed.
7.3 Referral Program
Each user may receive a personal referral code. If another new person lawfully uses the code and completes onboarding, that person currently receives their reward. The referral is currently successful once this person then forms their first connection.
- The referred user currently receives one week of Pro access.
- The referring user currently receives one additional month of Pro access. If the user already has an active paid subscription, one Spotlight credit is currently granted instead.
- Rewards are non-transferable and cannot be redeemed for cash.
- Self-referrals, multiple accounts, automated or deceptive distribution, and other misuse are prohibited.
Changes to the referral program apply only to future events that have not yet qualified. Rewards already validly credited, including under earlier contribution programs, will not be withdrawn solely because of a later program change.
7.4 Venue Contributions in Version 1.0
In version 1.0, you can add new places with basic factual information such as name, type, location, and opening hours, provided the requirements displayed in the app are met. No Pro or Spotlight rewards are granted for these contributions. Venue photo, menu, and scan contributions are not available in this version.
Contributions may be reviewed automatically and by people. Duplicate, unusable, infringing, deceptive, or abusive contributions may be rejected or removed. Accurate venue facts may remain after personal references have been removed, subject to Section 8.3.
7.5 App Store Subscriptions and Individual Purchases
Pro is offered as a monthly or yearly subscription. The monthly subscription automatically renews for one month and the yearly subscription for one year until canceled in the Apple Account settings. The selected billing period and its price are displayed before purchase. Cancellation generally takes effect at the end of the billing period already paid for, unless Apple or mandatory law provides for earlier effect or a refund.
Restorable purchases can be verified again using the app’s restore function. This requires the associated Apple Account and the Lunchdate account linked to the purchase. If Apple confirms a refund or revocation of the purchase, the corresponding paid entitlement may end. Your statutory rights remain unaffected.
A Spotlight purchase is a consumable digital credit and not a subscription. The price, currency, and product description are displayed by Apple before confirmation. Purchases are credited to the active Lunchdate account only after successful StoreKit verification.
Apple Media Services Terms additionally apply to billing, taxes, receipts, payment processing, Family Sharing, refunds, and the cancellation interface. Subscription management: https://apps.apple.com/account/subscriptions. Refund requests: https://reportaproblem.apple.com.
Deleting or pausing your Lunchdate account does not cancel an Apple subscription. Cancel an active subscription before deleting the account. Upon immediate account deletion, access to account-bound Pro features and unused Spotlight credits ends unless mandatory law requires a different result.
7.6 Rights of Withdrawal
7.6.1 Apple Store Transactions
For a Store transaction, the merchant shown in the purchase dialog or receipt is the recipient of a withdrawal. For users whose merchant is Apple Distribution International Ltd., the Apple Media Services Terms contain a 14-day withdrawal notice, contact details, and a model form. Apple recommends submitting the withdrawal via https://reportaproblem.apple.com and also provides rightofwithdrawal@apple.com in its terms. The terms shown at purchase and mandatory consumer law govern.
We do not limit statutory warranty, withdrawal, or refund rights. Merely enabling an ongoing digital service does not, by the start of performance alone, cause a right of withdrawal against Lunchdate to expire. For a Store transaction offered by Apple as merchant, Apple provides information about the applicable exceptions and procedure.
7.6.2 Free User Contract
To the extent you have a statutory right of withdrawal for the free user contract, you may withdraw from that contract within 14 days of its formation without giving any reason. Send an unequivocal statement by email to support@lunchdate.io or by post to the address in Section 1. To meet the deadline, timely dispatch is sufficient. You can additionally use the electronic function labeled "Withdraw from contract" provided for this purpose in the app; it is available without signing in from the start/sign-in screen. After reviewing the information, you can submit the declaration using "Confirm withdrawal"; we will confirm receipt immediately on a durable medium. That confirmation will reproduce the content of the withdrawal declaration and state its date and time of receipt.
Submission and the recorded receipt time of the withdrawal declaration do not depend on subsequently entering an email code. The one-time code is used solely for the secure assignment and processing of the contractual consequences. Neither the verification email nor the public response discloses whether the address is linked to a current account.
In the event of an effective withdrawal, the user contract ends and we delete or restrict the relevant data in accordance with the Privacy Policy and statutory exceptions. You may also terminate the free user contract at any time under Section 10; this broader termination right remains independent of the right of withdrawal.
Model Withdrawal Form
To Lunchdate UG (haftungsbeschränkt), c/o betahaus GmbH, Rudi-Dutschke-Straße 23, 10969 Berlin, Germany, support@lunchdate.io:
I/We hereby withdraw from the contract concluded by me/us for the use of Lunchdate.
Contract concluded on: [date]
Name of consumer(s): [name]
Address of consumer(s): [address]
Email address used for the account: [email address]
Signature of consumer(s), only if this form is notified on paper: [signature]
Date: [date]
Use of the form is not required.
8. Rights in the App, Content, and Venue Data
8.1 Our Rights
Software, design, trademarks, logos, our own text, and other components of the Service are protected. Subject to mandatory statutory rights, you receive for the term of the contract a personal, revocable, non-exclusive, non-transferable right to use the app as intended on your Apple devices.
In particular, unauthorized copying, distribution, making available to the public, commercial reuse, or reverse engineering is prohibited unless mandatorily permitted by law.
8.2 Your Content
You retain the rights in your content. You warrant that you possess the necessary rights and that uploading, publishing, and processing do not infringe third-party rights or applicable law.
For the duration and purpose of providing the Service, you grant us a non-exclusive, worldwide, royalty-free right to:
- host, store, back up, reproduce, and technically transmit your content;
- display or make it accessible within the Service to the users you designate;
- make technically necessary format, size, compression, cropping, preview, translation, and security adjustments;
- process it to the extent necessary for moderation, abuse prevention, preservation of evidence, and legal defense; and
- sublicense these rights to our processors for those purposes.
The right ends when the content has been deleted and we no longer need it for a statutory or legitimate retention reason. Content already duly received by other users and depersonalized factual venue data remain unaffected. We may remove content in accordance with these Terms but are not obliged to retain it permanently.
8.3 Venue Facts, Photos, and OpenStreetMap
OpenStreetMap master data is licensed under the Open Database License 1.0 ("ODbL"). We display the required attribution and license information: https://www.openstreetmap.org/copyright.
For factual venue data you contribute that is incorporated into our database connected with OSM data—such as name, address, coordinates, category, or opening hours—you additionally grant us a worldwide, royalty-free, non-exclusive, perpetual right, sublicensable under the ODbL or a compatible open database license, to include, review, modify, combine, and distribute that data in databases. To the extent legally possible, this also covers database rights. This right is necessary so that factual corrections remain usable after depersonalization.
Photos, menus, free text, and private reports are not placed under the ODbL solely because they are linked to a venue. The purpose-limited license in Section 8.2 applies to published photos and text.
Do not copy data from Google Maps, printed directories, or other sources whose license does not permit reuse. Venue information may be outdated or incomplete; verify important information directly with the venue.
9. Reports, Blocks, and Moderation
9.1 Notices of Illegal Content under Article 16 DSA
Users can report profiles, messages, images, and group content using the relevant in-app function. Any person, including someone without an account, may report allegedly illegal content to support@lunchdate.io.
A notice should contain:
- a sufficiently substantiated explanation of why the content is illegal;
- the precise electronic location, such as profile name, case/connection identifier, or message timestamp, and, where possible, further information for identification;
- the reporting person's name and email address, except for reports concerning alleged offenses under Articles 3 to 7 of Directive 2011/93/EU; and
- a statement confirming that the information is accurate and complete to the best of the reporting person's knowledge.
If electronic contact details are provided, we will promptly confirm receipt and communicate the decision, including available remedies. We process notices in a timely, diligent, objective, and non-arbitrary manner. A complete notice may give rise to knowledge of illegal content under Article 16(3) DSA.
9.2 Blocking
A block generally operates in both directions and restricts contact and visibility. After a connection ends or a user leaves a group lunch, the reporting function may remain available for a limited period, currently usually 48 hours.
9.3 Moderation Measures
Depending on the type, severity, frequency, context, and fault, we may:
- reject, remove, obscure, or restrict the visibility of content;
- issue a warning;
- temporarily restrict individual functions;
- temporarily suspend an account;
- terminate without notice and permanently block an account in the event of serious or repeated violations; and
- withdraw Pro, Spotlight, or reward benefits obtained through misuse.
Automated systems may provisionally reject content, apply rate limits, and prioritize cases for human review. The number of reports alone does not automatically lead to suspension or a permanent ban. These account measures are decided by an authorized person.
Before suspending or permanently blocking an account, we generally give an opportunity to comment. In the event of urgent safety, abuse, or legal risks, we may first take a proportionate provisional measure; reasons and an opportunity for review will follow without undue delay unless prevented by legal or safety reasons.
9.4 Reasons and Review
To the extent Article 17 DSA applies, we will clearly and specifically inform the affected user, at the latest when a restriction takes effect, of:
- the type, duration, and territorial scope of the measure;
- the relevant facts and circumstances and, where applicable, whether it was based on a notice;
- whether automated means were used for detection or decision-making;
- the legal or contractual basis; and
- available internal and out-of-court remedies.
A review can be requested informally at support@lunchdate.io. It is carried out by a person who is not bound solely by an automated result. We will communicate the outcome.
To the extent we meet the requirements for the microenterprise or small-enterprise exemption under Article 19 DSA, we are not required to provide the formal internal complaint-handling system under Article 20 DSA. Voluntary human review, mandatory rights, and out-of-court or judicial remedies remain unaffected.
9.5 Misuse of Content, Notices, or Remedies
Anyone who frequently provides manifestly illegal content may, following a prior warning, be suspended from providing content for a reasonable period. Anyone who frequently submits manifestly unfounded notices or complaints may, following a prior warning, be suspended from the relevant reporting or complaint function for a reasonable period.
We decide in each case in a timely, diligent, and objective manner. In particular, we take into account:
- the absolute number and relative proportion of clearly abusive events within a given period;
- the severity, nature, and consequences of the misuse;
- the intention, insofar as it can be identified; and
- previous warnings and the effect of less restrictive measures.
A suspension under this Section is time-limited and proportionate. Irrespective of this, serious violations of these Terms of Service may justify an account measure under Section 9.3.
10. Term, Termination, and Account Deletion
10.1 Term and Termination by You
The free user contract runs for an indefinite period. You may terminate it at any time without notice by deleting the account in the app settings. Alternatively, you may contact support@lunchdate.io if in-app deletion is technically unavailable.
Access ends immediately. Technical cleanup may occur asynchronously; statutory and moderation-related retention exceptions are governed by the Privacy Policy. Your contributions and content are deleted or depersonalized unless overriding rights or obligations apply.
10.2 Ordinary and Extraordinary Termination by Us
We may ordinarily terminate the free user contract with 30 days' notice in text form. Ordinary termination will not be arbitrary or discriminatory and will take account of ongoing paid entitlements usable through the account.
Both parties' right to terminate for good cause without notice remains unaffected. Good cause exists for us in particular in the event of serious or repeated rule violations, fraud, substantial misuse, danger to other people, or legal impossibility of continuation. Where reasonable, we will first give a warning and set an appropriate period to remedy the issue.
10.3 Consequences and Apple Subscriptions
When the contract ends, the account and the right to use the Service expire. Provisions that by their nature must continue, in particular on rights, liability, enforcement, and required retention, survive.
A subscription concluded with Apple must be canceled separately through Apple. Account-bound unused Spotlight or reward credits can no longer be used following immediate account deletion unless mandatory law requires a refund or other consequence.
11. Availability, Updates, and Changes to the Digital Product
We endeavor to maintain high availability but do not owe uninterrupted operation. Maintenance, security updates, disruptions, force majeure, or necessary provider measures may temporarily restrict the Service.
For the contract term, we provide security and conformity updates required by law. Install offered iOS and app updates within a reasonable period where we inform you of their availability and the consequences of failing to install them.
Your statutory rights in the event of defects in the digital product, in particular under Sections 327i et seq. of the German Civil Code (BGB), remain unaffected.
For continuous supply, we may change functions beyond what is necessary to maintain conformity, without additional cost, where there is a valid reason. Valid reasons are:
- adaptation to changes in law, binding decisions of authorities or courts, or App Store requirements;
- closing security vulnerabilities and defending against new patterns of abuse;
- technical changes to operating systems, interfaces, or services used;
- improving interoperability, accessibility, performance, or usability; and
- adapting to demonstrably changed use or discontinuing a scarcely used function, provided the overall contractual purpose is preserved.
We provide clear information about changes. If a change impairs access or usability to more than an insignificant extent, we will inform you within a reasonable period in advance, on a durable medium, of the features and time of the change and your right to terminate the contract free of charge within 30 days. This termination right does not apply if the impairment is insignificant or if we enable unchanged use at no additional cost. Section 327r of the German Civil Code (BGB) and more favorable mandatory provisions remain unaffected.
12. Changes to These Terms of Service
Changes to these Terms must be distinguished from product changes under Section 11.
We may make purely editorial corrections and changes to contact details without an adverse substantive effect and provide information about them in an appropriate manner. We will propose other changes in text form, with a clear explanation, generally at least 30 days before the planned effective date.
Changes to material contractual obligations, the relationship between performance and consideration, or other changes that are adverse to you become part of the contract only with your express consent, unless an immediately applicable change in law must be implemented. Silence does not constitute consent. If you reject a change requiring consent, the contract continues under the previous version insofar as this is reasonable and legally possible for us; otherwise, we may ordinarily terminate it under Section 10.
13. Liability
We have unlimited liability for intent and gross negligence, for damage resulting from injury to life, body, or health, under the German Product Liability Act, under an expressly assumed guarantee, and in other mandatory cases.
In the event of a slightly negligent breach of a material contractual obligation, we are liable only for the damage foreseeable at the time the contract was formed and typical for the contract. Material obligations are those whose performance is essential to the proper execution of the contract and on whose compliance you may regularly rely. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
We are not liable for other users' conduct undertaken on their own responsibility, the conduct of in-person meetings, or the accuracy of user-generated venue data, unless damage is based on Lunchdate's own breach of duty. Statutory obligations for digital products, platform services, and moderation remain unaffected.
14. Governing Law, Dispute Resolution, and Venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the country of your habitual residence.
Statutory venues apply to consumers. Exclusive venue at our registered office is agreed only to the extent permitted by law and where you are not a consumer.
The former EU Online Dispute Resolution platform has been discontinued. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board. Mandatory information and participation obligations remain unaffected.
15. Special Provisions for iOS and Apple
The following minimum provisions additionally apply to an app downloaded through the Apple App Store. In the event of conflict, mandatory law and any more favorable mandatory Apple requirement prevail.
15.1 Contracting Parties. These Terms of Service are concluded between you and Lunchdate, not Apple. Lunchdate is responsible for the app and its content. Under Section 7, a separate Store transaction may have an Apple merchant shown in the purchase dialog as its contracting party.
15.2 Scope of License. The app license is non-transferable and restricted to Apple devices that you own or control and to the usage rules permitted by the Apple Media Services Terms. Family Sharing or other authorized users remain possible to the extent permitted there.
15.3 Maintenance and Support. Lunchdate is solely responsible for app maintenance and support as agreed in these Terms or required by law. Apple has no obligation to provide them.
15.4 Warranty. Lunchdate is solely responsible for any express or statutory warranties for the app to the extent they have not been validly disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple; Apple will refund the purchase price paid for the app. To the maximum extent permitted by law, Apple has no further warranty obligations for the app. All other claims, losses, liabilities, damages, costs, and expenses attributable to such failure are the sole responsibility of Lunchdate. Mandatory consumer rights remain unaffected.
15.5 Product Claims. As between Apple and Lunchdate, Lunchdate is responsible for claims relating to the app or its use, in particular product-liability, legal-conformity, consumer, and data-protection claims, as provided by law.
15.6 Intellectual Property Rights. In the event of third-party claims that the app or its use infringes intellectual property rights, as between Apple and Lunchdate, Lunchdate is responsible for investigation, defense, and settlement.
15.7 Legal Eligibility. You represent that you are not located in a country subject to a US Government embargo or designated as supporting terrorism and that you are not on a US Government list of prohibited or restricted parties, to the extent this requirement lawfully applies to you.
15.8 Contact. Direct questions or claims relating to the app to the contact details stated in Section 1.
15.9 Third-Party Terms. When using the app, you must comply with applicable third-party terms, in particular those of your mobile network or internet provider.
15.10 Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms of Service and may enforce the provisions intended for them after your acceptance.
15.11 License Agreement and Order of Precedence. The app obtained through the Apple App Store is additionally subject to Apple's standard Licensed Application End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms govern the contractual relationship between you and Lunchdate. In the event of conflict, these Terms prevail over that license agreement, in particular regarding rights in the event of defects, liability, and governing law (Sections 11, 13, and 14). Mandatory law and any more favorable mandatory Apple requirement remain unaffected, as stated at the beginning of this Section. Separate Store transactions and Apple services are governed by the applicable Apple Media Services Terms: https://www.apple.com/legal/internet-services/itunes/ww/.
16. Language and Contact Points
The contract can be concluded in German, English, French, Spanish, Italian, Portuguese, Dutch, Danish, Swedish, Czech, Polish, Romanian, Estonian, Greek, or Ukrainian. We record the document language displayed when you accept.
These Terms of Service are available in several languages. In the event of discrepancies, the German version prevails unless mandatory law provides otherwise.
